Golden Traders Callout Service – Terms & Conditions

Terms & Conditions ("Terms") carefully before accessing or using the Golden Traders Callout Service (the "Service"). By registering for, accessing, or using the Service, you ("Member," "you," or "your") agree to be bound by these Terms. If you do not agree, do not register, access, or use the Service.

1. Definitions

"Golden Traders" means GoldenTraders and its affiliates, officers, directors, employees, agents, successors and assigns.
"Callouts" means disclosures of personal trades entered by GoldenTraders, together with general market commentary and educational explanations. Callouts are not signals, recommendations, alerts, or instructions to buy or sell any security.
"Member" means any person who registers for or uses the Service.

2. Eligibility & Access

Prerequisites. To access the Service, you must (a) be at least 18 years old and (b) successfully complete our mandatory compliance quiz.
Account Security. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. No Financial Advice

Educational Only. The Service is provided strictly for educational and informational purposes. Nothing on or through the Service constitutes financial, investment, tax, legal, or other advice.
Self-Directed Decisions. You acknowledge that you make all trading and investment decisions on your own, based on your own judgment and at your own risk.
No Registration. GoldenTraders is not registered as an investment adviser, broker-dealer, commodity trading advisor, or financial institution with the U.S. Securities and Exchange Commission, FINRA, the CFTC, or any state securities regulator.

4. No Copy Trading or Account Management

GoldenTraders does not provide copy trading, does not execute trades on behalf of Members, does not manage accounts, and does not accept discretionary authority over any account. Members are not instructed to mirror or replicate trades, and all execution decisions are made independently by each Member.

5. Risk Disclosure

Market Risks. Trading stocks, options, futures, cryptocurrencies, or any other instruments involves substantial risk of loss. Past performance does not guarantee future results.
No Guarantees. Golden Traders does not guarantee profits, returns, or avoidance of losses.

6. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS," "AS AVAILABLE," AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR RESULTS THAT MAY BE OBTAINED FROM USE OF THE SERVICE. GOLDEN TRADERS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL GOLDEN TRADERS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN ANY WAY CONNECTED WITH:

YOUR USE OF OR INABILITY TO USE THE SERVICE;
ANY CONTENT OR CALLOUTS PROVIDED;
ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE;
YOUR RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICE;
ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
ANY OTHER MATTER RELATING TO THE SERVICE;

EVEN IF GOLDEN TRADERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to defend, indemnify, and hold harmless Golden Traders and its affiliates, officers, directors, employees, agents, licensors, and partners from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of (or inability to use) the Service;
Your violation of these Terms;
Your violation of any rights of any third party;
Any allegation that your content or conduct harmed Golden Traders or a third party.

9. Termination

Golden Traders may suspend or terminate your access to the Service, without notice, for any reason, including if you breach these Terms. Sections 3 through 12 shall survive any termination.

10. Intellectual Property

All content, trademarks, service marks, trade names, logos, and other intellectual property on the Service (other than your own user-generated content) belong to Golden Traders or its licensors. You may not copy, reproduce, distribute, or create derivative works from any content without our express prior written permission.

11. Amendments

Golden Traders may modify these Terms at any time by posting an updated version on the Service. The "Last updated" date at the top will reflect the effective date. Your continued use after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles.

13. Miscellaneous

Severability. If any provision of these Terms is held invalid or unenforceable, the remainder will remain in full force and effect.
Waiver. No waiver by Golden Traders of any right shall be deemed a further or continuing waiver of such right or any other right.
Entire Agreement. These Terms constitute the entire agreement between you and Golden Traders concerning the Service and supersede all prior or contemporaneous agreements.

Dispute Resolution & Waiver of Jury Trial

Informal Negotiations. Before filing any claim, you agree to notify Golden Traders in writing and attempt in good faith to resolve the dispute within 30 days.
Binding Arbitration. If negotiations fail, any dispute arising out of or relating to these Terms or the Service shall be finally resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the seat in Wilmington, Delaware. The arbitrator's decision is final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
No Class Actions; Individual Claims Only. You and Golden Traders each waive the right to a jury trial and to participate in any class, collective, or representative action. All claims must be brought on an individual basis only.
Fees & Costs. Each party bears its own attorneys' fees and costs, though the arbitrator may award fees and costs as permitted by AAA rules.
Equitable Relief. Nothing prevents either party from seeking provisional or injunctive relief in court to protect its rights pending arbitration.
